Terms & Conditions
1. DEFINITIONS AND INTERPRETATION
1.1 Except where the context otherwise requires, any reference in these Conditions to:
“Conditions” means the Terms and Conditions of Sale set out in this document and any amendments that are made to them without notice from time to time by Regine Switzerland SA.
"Customer" means the person (legal or natural) who places an order and purchases Products on the eShop Web Site.
"Contract" means a contract between Regine Switzerland SA and the Customer for the sale of the Products covered by these Conditions.
"Price" means the purchase price in Swiss Francs (CHF) for the Product(s) specified on the eShop Web Site from time to time.
"Product(s)" means any goods or product(s) which are advertised for sale on the eShop Web Site from time to time.
"eShop Web Site" means the collection of web pages to be found at http://regine.ch/.
“Transaction” means a valid credit card payment transaction effected through the eShop Web Site between the Customer and Regine Switzerland SA for Products.
2. ESTABLISHMENT OF CONTRACT
2.1 Regine Switzerland SA shall sell and the Customer shall purchase the Products offered on the eShop Web Site, as principals only, to the intent and with the effect that no other party shall have any rights or obligations or be entitled to sue or be sued, under the Contract. For the purposes of these Conditions, a person who is not a Customer, as defined above, shall have no rights under the Contracts to enforce any term of these Conditions.
3. PERSONAL AND NON-COMMERCIAL USE LIMITATION
3.1 The Customer agrees that the eShop Web Site is for the Customers' personal and non-commercial use.
3.2 The Customer also agrees not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information or Products obtained from the eShop Web Site.
3.3 The Customer further agrees to use the eShop Web Site for lawful purposes only.
4. ORDERS AND PRODUCTS
4.1 Unless stated otherwise, payment for the Product(s) shall be made in full before physical delivery of Products.
4.2 All orders effected through the eShop Web Site shall be subject to the availability of stocks and any information on availability may be subject to change without notice.
4.3 As part of Regine Switzerland SA's policy of continous reviewing and updating of the Products it offers, Regine Switzerland SA may revise and/or discontinue Products offered on the eShop Web Site at any time without notice at its sole discretion.
4.4 ORDER PROCESSING
4.4.1 Regine Switzerland SA endeavours to process all properly completed orders within five (5) business days.
4.4.2 Orders placed on Saturday and Sunday will be processed the following Monday.
4.4.3 Orders are processed and shipped on business days only
5. PRICE AND PAYMENT - top
5.1 All prices quoted on the eShop Web Site are in Swiss francs (CHF) and subject to change without prior notice. These prices shall apply only to purchases made through the eShop Web Site and shall not be valid for any other on-going promotions. However, should such promotions be advertised on the eShop Web Site, then the promotional prices shall apply.
5.2 Prices are NOT inclusive of delivery and insurance charges. Customer shall add shipping and insurance charges to the Price. These are shown included in the total to be paid before confirming the purchase. Orders for deliveries within Switzerland are not subject to additional charges.
5.3 All purchases made on the eShop Web Site shall be paid by means of the cards listed. Regine Switzerland SA does not accept cash, credit vouchers or gift certificates as means of payment.
5.4 Regine Switzerland SA shall have the right to correct the Price at any time prior to delivery if there has been a typographical or other error in the Price. In the event that the Price stated on the eShop Web Site is incorrect, then the following shall apply:
(i) If the correct Price for the Product is lower than the Price stated by Regine Switzerland SA, then Regine Switzerland SA shall charge the lower amount and refund the Customer, the excess amount paid.
(ii) If the correct Price for the Product is higher than the Price stated by Regine Switzerland SA then Regine Switzerland SA shall, at its own discretion, either contact the Customer for instructions before processing the order or cancel the order and notify the Customer in writing of the cancellation.
5.5 Any reimbursement under condition 5.4 shall be net of any applicable administrative fees and without interest.
6. DELIVERY - top
6.1 Regine Switzerland SA shall deliver the Product(s) to the address the Customer has provided on the order form. Shipment is made by the Swiss Post Priority Service as registered mail. Shipping charges shall apply only to shipments made outside Switzerland, as follows:
Europe: 1-4 items = CHF 10.70 / 5-10 items = CHF 14.00
Other Continents: 1-4 items = CHF 12.00 / 5-10 items = CHF 16.50
Delivery will be effected within 5-6 Business Days.
6.2 Products are insured against the risk of loss and damage in transit. All shipping is processed with registered mail.
6.3 In the event of Product loss or damage in transit, it is the Customer’s responsibility to file a claim with Regine Switzerland SA by e-mail to firstname.lastname@example.org
6.4 As soon as practicable and in any case not later than 48 hours after placing the order, the Customer shall inform Regine Switzerland SA by e-mail to email@example.com of any changes to the delivery address. The changes shall not be effective until acknowledged by Regine Switzerland SA.
6.5 Any dates quoted by Regine Switzerland SA for the delivery of the Products are approximate only. Regine Switzerland SA shall not be liable for any delay in delivery of the Products for whatever reason.
6.6 If special packaging or delivery instructions are agreed upon by the parties, including overnight delivery services, all charges arising from them shall be billed to the Customer.
6.7 If the Customer fails to take delivery of the Product or fails to enable Regine Switzerland SA to make delivery, through an incorrect or incomplete delivery address provided by the Customer, for example, delivery shall be deemed to have been completed. If the Customer requests a replacement, the Customer shall bear all costs incurred, including postage and handling.
7. ACCEPTANCE OF PRODUCTS & RETURN POLICY - top
7.1 Acceptance of Products
7.1.1 Unless the Customer notifies Regine Switzerland SA to the contrary by telephone or e-mail on the day of delivery and the notification is confirmed in writing within two (2) business days, if made by telephone, the Product delivered shall be deemed to have been accepted by the Customer as being in good condition.
7.2 Return and Refund Policy
7.2.1 All Products sold shall not be returnable, refundable or exchangeable for other Products.
7.2.2 Subject to Condition 7.2.3, Regine Switzerland SA shall replace a damaged Product only if the item was delivered damaged or not conforming to Regine Switzerland SA’s standard. The Customer shall notify Regine Switzerland SA in writing within two (2) business days after delivery;
7.2.3 Regine Switzerland SA shall not replace an item that it concludes, at its sole discretion, has been damaged by the Customer.
7.2.4 If Regine Switzerland SA accepts the non-conformity, it shall refund the Customer by means of either a) issuing a Store Credit in full for the Product or b) refunding the credit card.
8. FORCE MAJEURE
8.1 Regine Switzerland SA shall not be liable for any delay in performing any of its obligations under these Conditions if the delay is caused by circumstances beyond its reasonable control and shall be entitled to a reasonable extension of time for the performance of its obligations.
9. LOGIN NAME AND PASSWORD
9.1 Your registered information will not be sold or transmitted to anyone outside of Regine Switzerland. Your E-mail address is necessary for receiving your online invoice. Your password and E-mail address can be used in the future to place additional orders without re-entering much of your information. All information transmitted from our webpages are secured by a SwissSign SSL (Secure Socket Layer) Certificate. Information exchanged with any address beginning with "https" is encrypted using SSL before transmission.
9.2 Customers shall be solely responsible for maintaining the confidentiality of their login name and password. Customers shall not to disclose their passwords to any other person. Customers shall be solely responsible for the access into and use of their accounts, whether or not authorised by them.
9.3 Customers shall notify Regine Switzerland SA eShop immediately if it comes to their knowledge that their password has been compromised or there has been unauthorised use of their account.
9.4 Regine Switzerland SA shall not be liable for any loss or damage of any kind suffered by Customers as a result of unauthorised use of their login names and passwords.
10. DISCLAIMER OF WARRANTIES
10.1 This eShop Web Site is provided by Regine Switzerland SA on an “as is” basis and “as available” basis. Regine Switzerland SA makes no representations or warranties of any kind, express or implied, as to the operation of the eShop Web Site or the information, content, data, materials or Products included on this eShop Web Site. The Customer expressly agrees that usage of the eShop Web Site is at the Customer's sole risk.
11. EXCLUSION OF LIABILITY
11.1 Regine Switzerland SA shall not be liable for any damages of any kind arising from the Customer’s use or inability to access and use the eShop Web Site or its Products, any of eShop Web Site’s contents or from any action taken or refrained from as a result of the use of the eShop Web Site.
12.1 These Conditions shall be governed by and construed in accordance with the laws of Switzerland and shall be subject to the non-exclusive jurisdiction of the Swiss courts.
12.2 These Conditions shall be subject to change and may be modified at any time. Any modification shall be effective immediately upon its posting on the modified Condition on the eShop Web Site.
